The Court of Appeal for the first time addressed the question of when information held by the BBC is subject to the Freedom of Information Act (FOIA). The Court decided that provided the information is held by the BBC for a genuine journalistic purpose, that information is not subject to FOIA, even if the information is also held for other purposes as well. The Court upheld the High Court’s decision that the information in question in this case fell outside FOIA, because the BBC was holding it for journalistic purposes.
