Pre-election and post-election statements by prominent members of the Labour Government regarding the Assisted Places Scheme did not give rise to a legitimate expectation that could be protected by law. Consequently the starting point was the Education (Schools) Act 1997 and any expectation had to yield to the terms of that Act. * Leave to appeal to the House of Lords refused.
