Michael Beloff QC and Ivan Hare have successfully established that the Joint Disciplinary Scheme for Accountants ('JDS') may disclose the fact that it has produced its Report into Ernst & Young’s auditing of Equitable Life and may provide a copy of the Report to the Financial Services Authority.
Michael Beloff QC and Ivan Hare have successfully established that the Joint Disciplinary Scheme for Accountants ('JDS') may disclose the fact that it has produced its Report into Ernst & Young’s auditing of Equitable Life and may provide a copy of the Report to the Financial Services Authority. Ernst & Young had previously sought to argue there could be no such disclosure pending the outcome its appeal against some of the Report’s findings. However, on 22 June 2009 before Gross J, Ernst & Young withdrew their judicial review and agreed to pay the JDS' costs. The case has been of much interest as part of the on-going fall-out from Equitable Life’s near collapse. Michael and Ivan were instructed by Bates Wells & Braithwaite.
