In an appeal against a planning decision, using the written representations procedure, there is no general obligation upon the appellant to disclose documents which express opinions which are adverse to his case. However, an appellant cannot “pick and choose” what to disclose if the effect will be that the Planning Inspector will be misled about the effect of what has been disclosed.
